Handle a notice about illegal content

Work the Reports queue, decide each Article 16 notice and let the reporter know the outcome.

Notices about illegal content on your service collect in Compliance › Content Safety › Reports, whether someone filed one on your Privacy Center or a member logged it. Any member of your workspace can decide a notice, and so can a DPO assigned to your workspace. The tab opens once Content Safety is subscribed to and its mandate is signed; see Open a register. Orders from authorities and your representative's public details are on the Representative and Settings tabs; see Letters from authorities and Publish your representative details.

Notices from your Privacy Center

While Content Safety is open and your Privacy Center has a published page, its home page offers Report illegal content. That leads to a form at /privacy/report, for example acme.prvcy.center/privacy/report, which asks what is being reported, where the content is, why the reporter believes it's illegal, and their role, name, email and language. The reporter confirms they're acting in good faith before selecting Submit notice.

When someone submits it:

  • The notice joins the queue as Open, received today, with Report form as its channel.
  • The reporter is emailed a confirmation of receipt, as Article 16(4) of the DSA requires. It quotes a reference: the first eight characters of the notice's ID, as shown in the queue's ID column.
  • A notification appears under Notifications, and your primary contact is emailed if one is named on Settings › Organization.

A notice about child sexual abuse material is filed without a name or email, as Article 16(2)(c) allows, so nobody is written back to. If the same reporter files the same links again within 10 minutes, the form returns the first notice's reference and records nothing new.

For a notice that reached you any other way, see Log a notice you received elsewhere.

Work the queue

The Reports tab lists every notice under Public reports, the most recently recorded first, with its content, category, reporter, received date, Response window and outcome. Search by URL, reporter or email, or narrow the list with the Status, Category, Decision, Reporter and Received filters.

The response window is the platform's own 14-day target, counted from the received date. It reads, for example, 12d left, then Overdue 2d. The DSA sets no number of days: Article 16(6) asks for notices to be processed and decided in a timely, diligent, non-arbitrary and objective manner. The reporter isn't shown the target.

Online platforms must give notices from trusted flaggers priority (Article 22(1)). The queue doesn't reorder them, so pick Trusted flagger in the Reporter filter to find them.

Notices also appear in the Inbox, and undecided ones on the compliance calendar. Opening one from either place opens the same drawer, with the same buttons.

Decide a notice

Open a notice to read what was reported, the reporter's own explanation and a Legal-completeness checklist of what the notice is owed. The drawer's footer has three buttons, Decide as take-down, Decide as demote and Decide as leave-up, and each opens the decision sheet:

  1. Check the decision: Take-down, Demote or Leave up. The one you chose is selected; picking another redrafts any text you haven't edited.
  2. Choose the Ground relied on: Illegal content or Breach of our terms.
  3. Rewrite the Legal basis to say what your review found, in at least 30 characters. It starts as a draft for the category and decision, and the statement of reasons is built from it.
  4. Tick Automated means were used to detect or decide this if they were.
  5. Pick an Appeal window of 180, 365 or 730 days, or enter your own number of days between 180 and 730. See Handle a complaint about a decision.
  6. Under Message to the reporter, edit the Reply or clear it. It starts as a draft and is emailed unless you clear it; if you keep it, it needs at least 30 characters.
  7. Select Confirm take-down, Confirm demote or Confirm leave up.

This is final. A decision can't be edited or replaced once you confirm it, and the reporter is emailed at once.

What happens when you decide

  • The notice's status becomes Decided, and its outcome reads Taken down, Demoted or Left up.
  • The reporter is emailed the decision, as Article 16(5) requires, whatever you decided. It goes out in your organisation's legal name, as entered on Settings › Organization, and states the outcome, what the content was assessed against, your reply word for word, whether automated means were used, the decision date, the last day to complain and the reference.
  • For a take-down or a demotion, the drawer shows the Article 17 statement of reasons. The platform doesn't send it to the person whose content you restricted; see Send a statement of reasons.
  • The complaint window opens, and complaints against the decision are logged in the drawer's Appeals section.

The email is in English and is sent from EU Presence's address, not a mailbox your team reads, so use your reply to tell the reporter how to reach you. Each send is listed under Settings › Email outbox. A notice filed without contact details gets no email.

For a duplicate, spam or a notice filed by mistake, there's no decision to make; see Close a notice without deciding.
